These Terms of Service ("Terms") govern your use of minimarko.app (the "Service"), operated by Mini Marko ("Mini Marko", "we", "us"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
Mini Marko is a free tool that reads a public company website URL you provide and generates short, ready-to-post videos by remixing publicly trending short-form clips and audio. The Service is provided free of charge and may change, pause, or be discontinued at any time.
2. Eligibility
You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract, to use the Service. The Service is intended for business and professional use.
3. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, deceptive, hateful, or infringing purposes;
- Submit URLs you do not have the right to reference, or content that violates the rights of others;
- Attempt to disrupt, overload, scrape, reverse engineer, or abuse the Service or its infrastructure;
- Use the Service to impersonate any person or misrepresent your affiliation.
4. Your content and your responsibility
You are solely responsible for the URLs you submit and for anything you create, download, or post using the Service. You decide where and how to publish the videos, and you are responsible for ensuring that your use complies with applicable law and with the rules of any platform (such as TikTok, Instagram, or YouTube) where you post them.
5. Third-party clips, audio, and intellectual property
Important: Videos generated by Mini Marko may incorporate publicly trending short-form clips, audio, meme formats, and other material created by third parties. Mini Marko does not own this underlying material and grants you no rights to it. We make no representation that any generated video is cleared for your intended use. You are responsible for determining whether your use and distribution of a generated video is permitted, and for obtaining any rights, licenses, or permissions that may be required. Videos may include a Mini Marko watermark.
The Mini Marko name, brand, and software are owned by us. These Terms do not grant you any rights in the Mini Marko brand.
6. No warranty
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability. We do not warrant that any video will perform, "go viral", or be free of third-party claims.
7. Limitation of liability
To the maximum extent permitted by law, Mini Marko and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service. Because the Service is provided free of charge, our total liability for any claim relating to the Service will not exceed one hundred US dollars ($100).
8. Indemnification
You agree to indemnify and hold harmless Mini Marko and its operators from any claims, damages, or expenses arising from your use of the Service, your content, the videos you publish, or your violation of these Terms or applicable law.
9. Changes to the Service and these Terms
We may modify the Service or these Terms at any time. When we update these Terms, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
10. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the courts located in the State of California, United States.
